On measures to improve the procedures for the examination of urban planning documents

In order to radically improve the system for the implementation of the examination of urban planning documents, further develop the activities of the subjects of urban planning activities related to the examination process by regulating their relationship on this matter, as well as ensuring transparency in the field through the full digitalization of expert procedural processes, the Cabinet of Ministers decrees following:

1. Starting October 1, 2021, introduce a procedure according to which, during the examination of urban planning documents:

consideration of urban planning documentation is carried out through the national information system “Transparent Construction” (hereinafter referred to as the information system) in accordance with the classification of objects by risk categories;

project documentation of works carried out at the expense of external investment funds received within the state budget and sources equivalent to them, guarantees of the state and state organizations are reviewed by the State Unitary Enterprise “Shaharsozlik hujjatlari ekspertizasi” [“Expertise of urban planning documentation”] or its territorial branches;

examination of design documentation for objects financed from other sources is carried out by accredited expert organizations – legal entities, State Unitary Enterprise “Shaharsozlik hujjatlari ekspertizasi” [“Expertise of urban planning documentation”] or its territorial branches according to the classification of risk categories of objects;

a positive expert opinion on project documents is recognized as valid if it is entered in the “Unified Register of Expert Opinions” of the information system by an expert organization;

a system will be introduced for calculating fees for services for the examination of urban planning documentation by expert organizations in a differentiated manner;

specialists of expert organizations should be certified in the prescribed manner and a system of their certification will be established;

develop and put into practice a methodology for using state statistics data on current prices for building materials, average prices for services of machines and mechanisms, average wages in preparing an expert opinion on the prices of resources used in the preparation of estimates for urban planning documentation

2. Approve the Regulations on the procedure for the examination of design solutions for urban planning and design documentation for the construction, reconstruction, overhaul and current repairs of facilities in accordance with urban planning documentation in accordance with Appendix 1 .

3. Approve the proposal of the Ministry of Construction of the Republic of Uzbekistan to strengthen the material and technical base of the State Unitary Enterprise “Shaharsozlik hujjatlari ekspertizasi” [“Expertise of urban planning documentation”] and its regional branches at the expense of the enterpriseʼs own funds.

4. It should be noted that from October 1, 2021, the conclusion of the Ministry of Construction of the Republic of Uzbekistan on the prices of resources used in the estimate documentation for urban planning and design documentation will be formed using:

the initial cost of facilities whose construction is financed from centralized sources, current prices for building materials, average prices for servicing machines and mechanisms, average wages, which are posted on the official website of the State Statistics Committee (stat.uz);

at the same time, taking into account that prices change throughout the year, introduce a system of mutual settlements using statistical data on the average price increase for a certain period.

5. The Ministry of Employment and Labor Relations of the Republic of Uzbekistan, together with the Ministry of Construction and the State Testing Center, within a month, in accordance with the established procedure, approve the regulation on the procedure for attestation and certification of experts involved in the examination of urban planning documentation.

6. Ministry of Construction of the Republic of Uzbekistan should:

until October 1, 2021, together with the Ministry of Development of Information Technologies and Communications, ensure the introduction of an improved system for the examination of urban planning documentation in the national information system "Transparent Construction";

Until November 1, 2021, on the basis of a plan approved jointly with the State Testing Center, expert organizations must certify experts;

Until November 10, 2021, together with the relevant ministries and departments, they must bring the legal documents they have adopted into line with this decision.

7. The Ministry of Construction of the Republic of Uzbekistan, the State Statistics Committee, the State Tax Committee, the Ministry of Employment and Labor Relations, official ministries and departments, within two months, submit to the Cabinet of Ministers a draft document on the introduction of an electronic rating of expert organizations, generated automatically on the basis of statistical and departmental data.

In order to further support and encourage expert organizations with the highest rating indicators, the draft document should provide for additional opportunities and benefits from the state.

8. Approve the List of Resolutions of the Government of the Republic of Uzbekistan, recognized as invalid, in accordance with Appendix 2.

9. Supervision of the execution of this Resolution shall be entrusted to the First Deputy Prime Minister of the Republic of Uzbekistan A.J. Ramatov and Minister of Construction of the Republic of Uzbekistan B.I. Zakirov.

on the procedure for the examination of design solutions for urban planning and design documentation for the construction, reconstruction, overhaul and current repairs of facilities in accordance with urban planning documentation

Chapter 1 General Provisions

1. This Regulation applies to urban planning documents of legal and natural persons (hereinafter referred to as the customer), project documents developed for the construction, reconstruction, overhaul and current repair, modernization, re-equipment of buildings, structures and other objects (working project , project-estimate documents, working documents) from the examination of the compliance with the requirements of legislative documents on urban development, earthquake resistance, engineering studies, energy efficiency indicators, fire protection and environmental norms and regulations, sanitary rules and norms, hygiene norms determines the transfer procedure.

2. The Regulation uses the following fundamental concepts:

expert – a highly educated specialist who has passed attestation in the prescribed manner and has an appropriate certificate, has at least five years of work experience in the construction industry (mainly worked in project organizations);

feasibility study (hereinafter - FS) – the most effective technical method of project implementation based on the study of alternative options, which determines the total maximum value of the project and the size of the financing need, taking into account the considered initial conditions of financing pre-project documents justifying the choice of technological and organizational solution;

working design (hereinafter – WD) – a design document consisting of a technical design prepared together with the approved part and working drawings, which are the main technical and economic indicators, and working documents that reflect the greatest value;

working documents – a project document consisting of a collection of working drawings for individual buildings and structures and types of work. When drawing up working documentation for complex objects, along with working drawings developed for the entire building and structure, additional studies are carried out on the defining materials of the project. Changes in the cost of man-hours and basic building materials should be included in the working documentation, specifications, dimensional diagrams for the relevant types of equipment and products, passports of working construction drawings of buildings and structures should be drawn up. As a rule, working documents are developed on the basis of a feasibility study approved in the prescribed manner;

network scientific and technical council (hereinafter – NSTC) – in order to determine the main technical and technological solutions of the project in terms of its compatibility with the prospects for the development of the network, taking into account the directions for the introduction of advanced technologies, deep processing of local raw materials by a collegiate body established by the decision of the initiator (customer);

urban planning documents – approved documents for planning the development of districts and settlements in terms of urban planning and their development.

3. Examination of urban planning documentation is carried out by specialized structural divisions of a specially authorized state body, specialized structural divisions of competent ministries, committees and departments, expert commissions and groups, as well as accredited legal entities (hereinafter referred to as expert organizations).

Examination of urban planning documentation of separately regulated objects of urban planning activities is carried out by specialized structural divisions of a specially authorized state body.

4. Urban planning documents are subject to examination for compliance with the requirements of legal documents on urban planning, seismic resistance, engineering surveys, fire and environmental standards and rules, sanitary rules and regulations, hygiene rules.

5. For the construction of urban planning objects, the technical part of the projects of urban planning documentation is subject to mandatory expertise, i.e., seismic resistance, energy efficiency indicators, fire safety.

6. For all construction objects, an examination of the estimated part of the projects is mandatory, with the exception of objects, the construction of which is carried out at the expense of direct investments, including foreign ones.

7. Examination of design documentation for the following facilities is not mandatory:

temporary and outbuildings for seasonal work;

small-sized facilities under construction with a volume of no more than three hundred cubic meters;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
single-apartment residential buildings with a height of no more than two floors (excluding the basement), a height of 12 meters above the ground and (or) a total area of not more than 500 square meters;

buildings and structures under current repair.

8. Experts and expert organizations are independent in their activities from the subjects of urban planning. No one has the right to interfere in the work of experts or expert organizations when considering urban planning documents and preparing expert opinions on them.

9. A positive expert opinion on project documents is recognized as valid if it is included in the “Unified Register of Expert Opinions” in the national information system “Transparent Construction” (hereinafter referred to as the information system) by expert organizations, with the exception of the examination of project documents containing information constituting a state secret.

10. Expert organizations and experts, in their activities are guided by the Constitution and laws of the Republic of Uzbekistan, decrees of the chambers of the Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, decrees and orders of the Cabinet of Ministers of the Republic of Uzbekistan, as well as this Regulation and other legislative acts.

11. Expert opinion on the prices of resources used in the assessment of urban planning and design documentation:

the initial cost of facilities, the construction of which is financed from centralized sources, is formed using the current prices for building materials posted on the official website of the State Statistics Committee (stat.uz), average prices for servicing machines and mechanisms and average wages;

taking into account price changes during the year, the average price for a certain period is calculated using statistical data on price increases.

Chapter 2 Tasks, functions, rights and obligations of expert organizations

12. Within their powers, expert organizations perform the following tasks:

a) ensure the organization and conduct of the examination of urban planning documentation in the prescribed manner;

b) consideration of disputes between customers, developers of urban planning documentation and other organizations in the field of urban planning activities;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
c) examination of master plans for cities and urban-type settlements, as well as architectural and planning projects for the territories of rural (village) gatherings of citizens;

d) advanced training of personnel, their retraining, training and certification in advanced foreign countries;

e) control measurements in construction.

13. Expert organizations perform the following functions in the performance of the tasks assigned to them:

a) in the field of ensuring the organization and examination of urban planning documents in the prescribed manner:

conducts an examination for compliance of projects of objects with urban planning, earthquake resistance, engineering surveys, fire and environmental standards and rules, sanitary rules and standards, hygiene rules;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
attracts, on the basis of a contract, specialists in urban planning, seismic resistance, engineering surveys, compliance with fire and environmental standards and rules, sanitary rules and regulations, sanitary and hygienic rules;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
monitors the conclusions of expert organizations on a quarterly basis and at the end of the year;

uploads expert opinions to the information system;

b) in the field of dispute resolution between customers, developers of urban planning documentation and other organizations in the field of urban planning activities:

considers disputes between customers, developers of urban planning documentation, contractors and other organizations at their request;

gives appropriate conclusions regarding disagreements;

submits to a specially authorized body a report on design organizations that have made gross shortcomings and errors in design;

c) in the field of examination of master plans for cities and urban-type settlements, as well as architectural and planning projects for the territories of settlements (villages) by citizensʼ gatherings:

within its powers, conducts an examination of master plans for cities and urban-type settlements, as well as architectural and planning projects for the territories of settlements (villages);

within the limits of its authority, when conducting an examination of master plans for cities and urban-type settlements, architectural and planning projects of settlements (villages) in terms of urban planning, compliance with urban planning, seismic resistance, engineering surveys, fire inspection of combat and environmental standards and rules, sanitary rules and norms , hygiene standards;

evaluates the quality of the performed design and survey work;

d) in the field of advanced training of personnel, their retraining, training and certification in advanced foreign countries:

constantly improves the qualifications of the staff;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
takes measures to train, retrain and improve the skills of specialists in foreign developed countries;

provides certification of experts in accordance with the established procedure;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
ensures that the experts pass the certification in a timely manner;

e) in the field of control measurements in construction:

checks the completeness and correctness of the preparation of urban planning documentation and reports for the construction site;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
measures the volume of actually performed physical work at the construction site on the basis of project documents, proposals and invoices for the work performed;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
based on the results of the control measure by type of work, it is determined whether the types of work provided for in the project documents, offer and reports are actually being carried out;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
shows deviations from the project in the amount of actually performed work at the construction site as a result of the control measure;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
checks the use of dimensions, calculation, technical parameters and quality of building materials at construction sites on the basis of a mutual official agreement, contract, offer, project documents and reports between the customer and the contractor;

checks whether the tests of equipment and communication systems reflected in the reports were really carried out;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
ensures the confidentiality of the results of control measurements;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
checks reports for arithmetic errors and other calculations.

14. Expert organizations have the following rights:

verification of the compliance of the adopted architectural, planning and urban planning decisions with urban planning norms and rules;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
verification of compliance with the mandatory requirements of urban planning norms and rules, mandatory requirements for the use of energy-efficient and energy-saving technical, technological and innovative design solutions;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
providing an opinion on the results of the examination;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
to assess the quality of the performed design and survey work.

Expert organizations may also have other rights in accordance with the law.

15. Experts have the following rights:

participation in expert commissions (expert groups) for comprehensive urban planning expertise of regional urban planning projects;

request and receive the necessary materials and information from customers and developers;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
in accordance with the professional specialization of urban planning activities, conducting expert examinations for individual departments (parts) of projects, drawing up local expert opinions on them. Local expert opinions for individual departments (parts) are not considered the basis for the general approval of urban planning documentation and are used to draw up a consolidated expert opinion;

in cases of non-compliance by the customer with the conditions (requirements) specified in the expert opinion, offer to withdraw the expert opinion previously issued by the expert organization.

Experts may have other rights in accordance with the law.

16. Expert Responsibilities:

ensuring observance and safety of state secrets and other secrets protected by law in relation to the considered projects of urban planning documents;

improving professional skills;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
must comply with the rules of professional ethics.

Experts may also have other responsibilities.

conducting an examination of projects directly or indirectly involved in the preparation of this examination, or projects carried out with the participation of a husband (wife) and (or) other close relatives;

be in labor, financial and (or) other subordinate relations with the subjects of urban planning activities.

Chapter 3 The procedure for submitting and considering urban planning documentation to expert organizations

18. The procedure for the submission and consideration of urban planning documents to expert organizations through the national information system “"Transparent Construction” is carried out in accordance with Appendix 1 to this Regulations.

19. The customer submits an application for the examination of urban planning documentation through the information system in electronic form through the information system to expert organizations in the following order:

а) for new construction – in accordance with Appendix 2 to this Regulation;

b) for reconstruction – in accordance with Appendix 3 to this Regulation;

c) for a major overhaul – in accordance with Appendix 4 to this Regulation;

20. Urban planning documentation is reviewed through the information system in accordance with the classification of objects by risk categories.

21. Project documentation for works performed at the expense of foreign investment funds received under the guarantees of the state budget and equivalent sources, government organizations and non-governmental organizations are reviewed by the SUE “Shaharsozlik hujjatlari ekspertizasi” [“Expertise of urban planning documentation”] or its territorial branches. Project documentation for objects financed from other sources is subject to expert examination by expert organizations at the voluntary request of the customer.

22. Expertise of urban planning documentation is considered by risk categories in the following order:

Objects of the 1st category – examination of project documentation is not required;

Objects of category II – examination of project documentation is carried out by expert organizations at the discretion of the customer in accordance with paragraph 21 of this Regulation;

Objects of category III – project documents submitted by the customer through the information system are sent to the SUE “Shaharsozlik hujjatlari ekspertizasi”. These documents can be sent to regional offices or expert organizations of the SUE “Shaharsozlik hujjatlari ekspertizasi” or reviewed by itself;

Objects with an attendance of 5,000 or more people (including large shopping malls) undergo an examination by the SUE “Shaharsozlik hujjatlari ekspertizasi” or its regional branches;

Objects of category IV – project documents are reviewd only by the SUE “Shaharsozlik hujjatlari ekspertizasi”.

23. Pre-project documents (feasibility studies) of objects implemented at the expense of investment funds and projects under import contracts are subject to examination by the SUE “Loyihalarni va import kontraktlarni kompleks ekspertiza qilish markazi” [“Center for Comprehensive Expertise of Projects and Import Contracts”] under the Ministry of Economic Development and Poverty Reduction under a separate procedure.

24. The corresponding application sent by the customer through the information system will be checked by an expert organization within three working days.

If, as a result of the verification, the urban planning documents are incomplete or the attached documents do not meet the specified requirements, the expert organization notifies the customer through the information system about the elimination of the identified deficiencies within five working days.

From the date of receipt of the relevant request from the expert organization about the identified deficiencies, the customer, within ten working days, submits the relevant documents to the expert organization through the information system.

25. Copies of positive conclusions issued by expert organizations must be electronically uploaded to the program “Expertise of project documents” of the information system.

Project documents of separate and important objects are excluded.

26. In accordance with the relevant documents, an expert opinion on objects carried out simultaneously with construction work is issued through the information system in stages and to the extent according to the schedule specified in the expert agreement.

27. Expert organizations prepare a consolidated expert opinion on urban planning documents, taking into account expert (industry) opinions of independent experts (expert groups) involved in the consideration of urban planning documents.

28. The consolidated expert opinion, drawn up based on the results of the examination of urban planning documentation, is signed by the expert and approved by the head of the expert organization, and the expert opinion given in the prescribed manner is sent to the customer.

29. The customer and the design organization are responsible for the quality of urban planning documents submitted to the expert organization, the reliability of the initial data and the adopted design decisions.

Chapter 4 Expert cost of urban planning documents

30. Examination of urban planning documentation is carried out on the basis of an agreement between the customer and expert organizations.

After making a 100% prepayment in accordance with the agreements concluded with the SUE “Shaharsozlik hujjatlari ekspertizasi” and its regional branches, an expert opinion on urban planning and design documentation will be submitted.

At the same time, an advance payment in the amount of 30 percent is paid by the customer in the process of input (unloading) of design and estimate documentation through the electronic system.

The amount of the advance in contracts for the examination of urban planning documentation of accredited legal entities is determined in accordance with the law.

31. The cost of premises for domestically produced equipment is reflected in the expertise summary.

32. Prices for objects, the construction of which was carried out simultaneously with the design documentation, are calculated based on the prices prevailing on the ground, on the basis of a price offer agreed between the customer and the contractor.

33. The fee for the examination of urban planning documentation by expert organizations is calculated in accordance with Appendix 6 to this Regulation.

Chapter 5 Terms for consideration of urban planning documentation

34. By risk category:

Examination of urban planning documentation of objects of category I will be considered within fifteen days;

Expertise of urban planning documentation of objects of II, III and IV categories will be considered within thirty days.

35. Based on the volume and complexity of urban planning documentation, the terms of the examination can be extended by agreement of the parties.

36. The period of validity of expert opinions issued by expert organizations for urban planning documents is 2 years.

Chapter 6 Expert opinion

37. The expert opinion should include:

a brief description of information about the conditions for the implementation of construction and the main design decisions and sources of technical and economic indicators of the construction object;

specific comments and suggestions on changes and additions to urban planning documents regarding the design decisions adopted during the examination;

recommendations for additional detailed refinement of individual design solutions during the subsequent design process;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
description of the project of the object in accordance with urban planning norms and rules;

a conclusion indicating the reasons for the recommendations given for the approval of urban planning documentation (in the absence of serious objections leading to a change in design decisions and main technical and economic indicators) or rejection (return for revision).

38. The results of the examination are considered to be a consolidated expert opinion, which reflects:

requirements that urban planning documents meet the established requirements and be recommended for further consideration and approval;

the marginal cost of construction objects, with the exception of the cost of objects, the construction of which is carried out at the expense of direct investment, including foreign investment;

non-compliance of urban planning documentation with the established requirements, applications for rejection or return for reconsideration.

39. A positive conclusion of the expertise of urban planning documentation is the basis for:

approval of urban planning documentation in the prescribed manner;

development of the next design stage;

registration of an object in the field of construction in the regional control inspection;
Ҳужжатга таклиф юборишАудиони тинглашҲужжат элементидан ҳавола олиш
preparation of tender documentation;

make funding.

40. A sample form of an expert opinion of an urban planning document is drawn up in accordance with Appendix 7 to this Regulation.

41. The conclusion is drawn up in two copies, one copy remains with the customer, the second - with the expert organization.

Chapter 7 Final Provisions

42. In case of changes in design solutions, including changes in the design of objects under construction or existing (there are changes that affect the seismic resistance of the building and fire safety), a re-examination of urban planning documentation is carried out in terms of the changes made.

43. The conclusions of expert organizations may be appealed in accordance with the procedure established by law in relation to illegal actions (inaction) of their officials.

44. If officials detect errors or cases of low-quality expertise at least three times during the year, according to the information and indicators specified in the conclusions issued by a certain expert organization, a document (certificate) is drawn up authorizing the expert organization to conduct an expertise will be canceled by the competent authority and will be deprived of the right to engage in this activity for three years.
