Over the past few years in the country carried out a significant work on improvement of the activity oflocal executive bodies in the field, aimed at increasing their independence and responsibility for the timely and effective solution to the vital problems of the population and subjects of entrepreneurship.

At the same time, a study of the real state of affairs in Tashkent city indicates the presence of systemic problems and shortcomings that hinder the growth of business activity, attracting investment in the development and modernization of economic sectors.

In order to indigenous improve the investment climate in Tashkent city, as well as in accordance with the objectives of the Strategy of Actions on five priority directions of development of the Republic of Uzbekistan in 2017 — 2021 years, and the Concept of administrative reform in the Republic of Uzbekistan:

1. To take a note that the Decree of the President of the Republic of Uzbekistan from 1 on August 2018 the year No. DP-5495 “On measures for radical improvement of the investment climate in the Republic of Uzbekistan”:

a) from 1 October 2018 the year introduced the following new mechanisms of land plots for the implementation of investment activity:

long-term lease of the land plots of non-agricultural purpose in the period up to 50 years, but not less than the period specified in the application, for the implementation of investment projects;

b) the right is granted:

Chairman of the Council of Ministers of the Republic of Karakalpakstan, hokims of regions and Tashkent city to sign the investment contract with foreign investors during the implementation of investment projects with a share of foreign investments in the equivalent of no more than 10 of millions of USA dollars, in the limits of the powers and in accordance with the procedure established by law;

Jokargy Kenes of Karakalpakstan, the Councils of people's deputies of regions and Tashkent city to take decisions on the implementation of unused objects of state property (with the exception of the objects listed in Appendixes No. 1 and 2 to the Resolution of the President of the Republic of Uzbekistan on 16 June 2017 the year No. RP-3067 “On measures to further improve the procedures for the sale of state property”), the total area of which is more than 2000 square meters, but not more than 5000 square meters, for the implementation of investment projects.

2. To accept the proposal of the Cabinet of Ministers and khokimiyat Tashkent city on hold from 15 on August 2018 the year to 15 on August 2019 the year of the experiment of the improvement of the investment climate in Tashkent city (hereinafter — the experiment), implying the following:

realization of objects of state property, in that those unused on the basis of the investment agreement by the end of direct negotiations with investors for the decision hokim of Tashkent city, regardless of their area of exception objects in the areas in which the individual decisions of the President of the Republic of Uzbekistan provided the introduction of public-private partnerships;

the provision by the decision of the hokim of Tashkent city of the functions of directorates of small industrial zones to private management organizations on the basis of a trust management agreement;

implementation on the basis of decisions hokim of Tashkent city, transformation ofshares of local statebodies in the authorized capital (funds) markets and shopping complexes, regardless of their balance value and the number of workers of subjects of private entrepreneurship with the condition of preserving the profile of activities, taking investment and social obligations as well as the transfer of the private managing organizations the functions of the executive body of markets and shopping complexes on the basis of an agreement for the organization and conduct of business. At the same time, to provide for the preservation of one municipal market in each district with a share of the local state body;

implementation of the decision hokim of Tashkent city projects for the organization of paid car parking places along the road to the conditions of public-private partnership, the approval of programs of construction of multi-level car parking with the involvement of private investors;

transfer of subjects of entrepreneurship, offered the greatest amount of lease payments and investment commitments mostly have experience in the implementation of innovative projects in the field of road traffic, places of temporary storage of cars which are in the conduct of local state bodies, in that those located in the surrounding areas of markets and trade complexes for rent for up to 10 years on a public-private partnership.

3. To establish a Working Group for the coordination of the experiment to improve the investment climate in Tashkent city(hereinafter referred to as the Working Group), composed according to the appendix.

Assign to the Working Group (A.N. Aripov):

operational settlement and approval of the issue of the transfer functions of the Directorates of small industrial zones to private control organizations, as well as the parameters proposed to the implementation of investment projects and the basic conditions of public-private partnership for the subsequent decision-making hokim of Tashkent city on the issues of implementation or transfer to rent of objects of state property;

ensuring a clear coordination of activities of ministries, departments, local state bodies in the field of provision of practical assist in solving organizational and technical issues related to the conduct of the experiment and the realization of investment projects, operational adoption of measures for the prevention of the facts of bureaucracy;

qualitative organization, coordination and monitoring of the experiment, prompt consideration and adoption of agreed decisions on all issues in the framework of the experiment.

4. To establish the procedure in accordance with which in the framework of the experiment:

the day of the investoris held by the Khokimiyat of Tashkent city on a weekly basis, in the framework of which, as a rule, the Working Group considers investment proposals subjects of entrepreneurship, as well as among foreign investors about the conclusion of investment contracts, realization of objects of state property to the implementation of investment projects with the placement of the relevant information on the website Khokimiyat of Tashkent city;

failure in one month term after the direction request the Khokimiyat of Tashkent city of their balance sheet the proposals provide for measures for the effective use of unused objects, in fact including the creation of an object of production or spheres services, transfer of object specific tenants, attracting a particular investor (partner), as well as specific deadlines for restoration of an unused facility and sources of financing is the basis for the adoption of decisions khokim of Tashkent city on the realization or transfer of unused objects of state property on the basis of the investment agreement;

settlement and approval by the Working Group of parameters offered by the implementation of investment projects for subsequent decision-making khokim of Tashkent city on the issues of implementation and transfer of objects of state property is carried out in within ten working days;

the powers of the administrative council of the free economic and small industrial zones of Tashkent city are transferred to the khokim of Tashkent city, who can delegate these powers in full or in part to the directorates of small industrial zones;

construction of necessary external engineering and communication networks for outside production sites in the framework of specific investment projects can be carried out for the account of means of the local budget of Khokimiyat of Tashkent city and other sources of funding.

5. To establish that from October 1, 2018:

the procedure for paying a fixed tax is canceled by legal entities providing services for the temporary storage of cars, with the transition to the payment of a single tax payment or generally established taxes in the manner established by the Tax Code of the Republic of Uzbekistan;

services for the temporary storage of cars, regardless of location, are provided by legal entities when equipping temporary storage places for cars with a video surveillance system and recording the time of arrival and departure of cars that allows you to interact with tax authorities.

The State Tax Committee of the Republic of Uzbekistan to establish systemic control over the completeness of the proceeds of legal entities providing temporary storage services for motor vehicles.

6. To present to hokim of Tashkent city right to enter into investment contract with foreign investors during the implementation of investment projects with a share of foreign investments in the equivalent of more than 10 of millions of USA dollars under the condition of absence of requirements by the foreign investor additional to the established laws of the tax and customs benefits and preferences.

7. To agree with the proposal Khokimiyat of Tashkentcity, the Ministry of Economy, the State Committee of the Republic of Uzbekistan for the promotion of privatized enterprises and the development of competition on the gratuitous transfer on the basis of acts of reception and transmission KKhokimiyat of Tashkent city of buildings, structures and other infrastructure airline “CAP” of NAC “Oʼzbekistan havo yoʼllari”with an adjacent territory of 101.64 hectares, located at the address: Tashkent city , Sergeli district, st. Raykhon, with the subsequent creation on the basis of the transferred objects of “Industrial Park” small industrial zone.

8. Khokimiyat of Tashkent city:

a) in order to create the most comfortable conditions for doing business and creating a favorable investment climate, increase investment attractiveness of Tashkent city in the context of areas, as well as the implementation of the organizational measures required to ensure economic growth and increase the level of life of the population in the two-month periodin cooperation with the district administrationsto develop:

investment passports of districts and Tashkent city, providing for the reflection of the opportunities and conditions available in the respective territories;

the concept of development of the investment climate in Tashkent city in the context of areas, defining the main objectives of management of investment processes, measures for the development of priority sectors, the limitations associated with the preservation of cultural and social facilities, a favorable environmental condition surrounding environment, as well as indicators characterizing the effectiveness of the concept;

the procedure of meetings, wiring and servicing investors in airports, at railway stations, sites visited, providing them the necessary transport and technical means to determining the responsible persons and the sources of financing;

b) together with the administration of the Tashkent region within a week, submit to the Cabinet of Ministers a draft resolution of the President of the Republic of Uzbekistan on the revitalization of the small industrial zones of Tashkent city, the optimal use of vacant land, organization of activities on their basis of small industrial zones, providing, if necessary, the allocation of land plots with an area of at least 20 hectares each to create new small industrial zones of Tashkent city in the territories of the Tashkent region adjacent areasof Almazor, Yunusobod, Chilonzor and Sergeli districtsof Tashkent city;

c) in a monthly term to develop a calendar schedule of meetings and negotiations khokims of Tashkent city and districts, as well as their deputies, in that those traveling to foreign countries to attract potential investors, bring to foreign partners information about the investment potential and conditions of doing business.

9. To impose on performing duties khokim of Tashkent city J.A.Artikhadjaev is responsible for:

compliance by initiators of investment projects with urban planning regulations and requirements for the quality of construction and installation works;

unconditional, timely and qualitative execution of assigned tasks and functions, the effective implementation of investment projects, the decision of problems of subjects of entrepreneurship, turning in its activities special attention to the impact of ongoing work on the improvement of the investment climate, guided by the principles of objectivity and transparency, as well as keeping the interests of the population of Tashkent city;

ensuring sources of financing obligations of the state, resulting in the result of the realization of investment projects in the framework of the experiment;

the effectiveness of measures implemented in accordance with paragraph 8 of this Decree;

preservation of the old-city part of Tashkent city, objects of cultural heritage and a favorable ecological state of the environment, increasing the level and quality of life of the population, creating green areas with planting of decorative trees and flowers, protection from illegal cutting of trees and plantings;

prompt response to appeals and complaints of citizens, placed in social networks, and associated with various kinds of violations (illegal felling of trees, damage to objects of cultural heritage and others).

10. Working Group (A.N. Aripov, S.R.Kholmuradov) ensure prompt consideration of issues introduced in the agenda of the day of the Working Group, as well as the unconditional execution of assigned tasks and functions.

11. To impose personal liability on the heads of ministries and departments for the provision of comprehensive support Khokimiyat of Tashkent city and the subjects of entrepreneurship, implementing investment projects, as well as the solution of emerging problems.

12. The Ministry of Construction of the Republic of Uzbekistan in cooperation with the Khokimiyat of Tashkent city in the two-month period to make proposals for the improvement of the order of granting permission to facilities, located in a residential area, with a view of the features and the need for the construction of objects of housing and hotel sector, health, education, children's institutions and other social infrastructure.

13. Divisions of Adviser to the President of the Republic of Uzbekistan on the issues of legal support of the reform and the coordination of law enforcement activities:

together with the General Prosecutor's Office of the Republic of Uzbekistan to establish effective control and monitoring of the implementation of the experiment;

together with the Khokimiyat of Tashkent city, based on the results of the experiment, make proposals on extending the effect of this Decree to other regions of the republic.

Khokimiyat city of Tashkent on a monthly basis to present information about the effectiveness of taken measures in accordance with the present Decree to the Cabinet of Ministers and the Administration of the President of the Republic of Uzbekistan.

14. To recommend the Senate of the Oliy Majlis of the Republic of Uzbekistan to assist the Kengashes of Peopleʼs Deputies of Tashkent city and regions in organizing and implementing effective parliamentary control over the activities of executive authorities of Tashkent city and regions.

15. National television and radio company of Uzbekistan, the National information agency of Uzbekistan and other means of mass information to provide a broad coverage of the provisions of this Decree, the available opportunities and the results of investment agreements and the benefits of public-private partnership.

16. The control over the implementation of this Decree is entrusted to the Prime Minister of the Republic of Uzbekistan A.N. Aripov , First Deputy State Advisor to the President of the Republic of Uzbekistan B.M. Mavlonov and performing duties khokim of Tashkent city J.A. Artikhodjaev.
