On additional measures to simplify the public services delivery, reduce bureaucratic barriers and develop a national system for the delivery of public services

Systematic work is being carried out in the republic aimed at eliminating bureaucracy, red tape and other administrative barriers in the delivery of public services, a radical reduction in outdated procedures that do not meet modern requirements.

In particular, the requirement for the population and business entities to provide 73 types of certificates and documents was canceled, a system was introduced for obtaining relevant information by state bodies with using the interdepartmental integration platform of the Electronic Government system.

Along with this, it is necessary to consistently continue work to increase the scale of public services delivery to the population in a convenient and accessible form, to avoid unnecessary visits by citizens to various departments, and to reliably protect information available in the information systems of state bodies.

In order to increase the scale of the public services delivery to natural persons and legal entities, expand the possibility of remote independent access for the population to electronic public services, as well as the formation of an inclusive environment by creating equal conditions for all in this direction, hereby I decree:

1. Starting August 1, 2022:

a) to implement the Mobile-ID (hereinafter referred to as Mobile-ID) system for identifying natural persons in addition to the existing system and means of identification for using public services;

b) to establish the procedure in accordance with which:

Mobile-ID system shall be deemed an integral part of the Unified Information System for Identification of Users of the Electronic Government System, which provides for the identification of a person by means of mobile phone number;

identification of a person using the Mobile-ID system shall be carried out at the request of citizens by public service centers (hereinafter referred to as centers) or notary offices or through the mobile application of the Single Portal of Interactive Public Services (hereinafter referred to as SPIPS);

when a citizen applies directly to the Center or a notary's office for identification using the Mobile-ID system, an original identity document shall be presented, while an employee of the Center or a notary's office shall photograph the citizen's face in digital format, take fingerprints of hands in electronic form, and the number of the mobile phone of this citizen shall be linked without consideration to their personal account on the SPIPS;

when a citizen uses the SPIPS mobile application for identification using the Mobile-ID system, the method of remote biometric identification (Face-ID) or an electronic digital signature in the ID-card shall be used, and their mobile phone number shall be linked to a personal account on the SPIPS without consideration;

identification of citizens directly by the Centers or notary offices using the Mobile-ID system shall be carried out until December 31, 2022 — without charging a fee, and starting from January 1, 2023 — with a one-time fee of 2 percent of the base calculated value;

users of the Mobile-ID system can use all public services (except for financial ones) without using an electronic digital signature;

all notifications which are sent to the citizen's personal account at SPIPS shall be sent at their request and on the basis of established payments in the form of SMS messages to the mobile phone number identified using the Mobile-ID system.

2. To determine that the expenses associated with the implementation and further technical support of the Mobile-ID system shall be covered by the Public Services Development Fund of the Ministry of Justice and extra-budgetary funds of the Ministry for the Development of Information Technologies and Communications or other sources not prohibited by acts of legislation, in an equal share.

3. To determine the following priority areas of activity of the Ministry of Justice for the next five years upon implementing the tasks for public services delivery to the population and business entities:

modernization of the national system for the public services delivery on the principle of “Citizen in the center of attention in the delivery of public services” (Citizen — centric service);

expanding the capabilities of information and communication technologies used in the activities of the centers, a sharp increase in the level of use of electronic public services by the population and paperless office work;

optimization of each public service based on Business Process Reengineering methods, including the full application of the “one stop shop” principle in practice by minimizing the time limits and required documents;

introduction of new types of public services, as well as the merger or abolition of public services that have lost their relevance, coming out from the ongoing state of socio-economic and technological development, as well as the needs and requirements of the population and business entities;

creation of an inclusive environment in the public services delivery to persons with disabilities;
Suggestion to the documentListen to audioGet a link from a document element
expanding the practice of delivering proactive public services at the initiative of state bodies, as well as interconnected composite public services per a single application;

creation of the necessary conditions for self-service, regular improvement of the skills of independent use of public services among the population and business entities.

4. To approve:

National Strategy for Modernization and Accelerated Development of the System for the Public Services Delivery for 2022 — 2026 in accordance with Annex No. 1;

“Roadmap” for the implementation in 2022-2023 of the National Strategy for the Modernization and Accelerated Development of the System for the Public Services Delivery for 2022 — 2026 in accordance with Annex No. 2;

List of licenses and permits, certain requirements and conditions of which shall be canceled from July 1, 2022, in accordance with Annex No. 3;

List of public services which do not require confirmation by an electronic digital signature on the Single Portal of Interactive Public Services from June 1, 2022, in accordance with Annex No. 4;

Schedule for the integration of information systems of state bodies and organizations into the electronic notification system for public services provided to the public and business entities within the framework of the Electronic Government, in accordance with Annex No. 5;

Schedule for the phased integration of information systems and databases of state bodies authorized to conduct and consider cases on administrative offenses into the Unified Billing System in accordance with Annex No. 6;

Targets (indicators) for the accelerated development of the system for the public services delivery in 2022 — 2026 in accordance with Annex No. 7.

5. To establish that from July 1, 2022, requesting by utility organizations from the population, including business entities, of information and documents provided for in paragraph 4 of the Decree of the President of the Republic of Uzbekistan dated March 23, 2021 No. UP-6191 and paragraph 5 of the Decree of the President of the Republic of Uzbekistan dated July 24, 2021 No. UP-6269, shall be canceled.

To Regional Electric Networks JSC, Khududgaztaminot JSC, Uzsuvtaminot JSC and Toshissikkuvvati State Unitary Enterprise, together with the Ministry for the Development of Information Technologies and Communications, by June 1, 2022, to ensure the integration of their information systems with the Digital Data Platform operating within the framework of Electronic Government systems.

6. In order to improve the quality of services and create the most favorable conditions for citizens and the private sector, to ensure, from September 1, 2022, access for the following non-governmental organizations to information that can be obtained through the Electronic Government system:

commercial banks;

telecommunications organizations;

private medical institutions;

non-state educational organizations;

insurance organizations.

To determine that non-governmental organizations which have received permission to use the Electronic Government system shall be required to take the necessary organizational and technical measures for protecting personal data and not disclosing it to third parties. In this respect, compliance with the requirements of acts of legislation on personal data shall be deemed one of the requirements and conditions of the relevant license.

7. To the Ministry for the Development of Information Technologies and Communications:

within a month, to develop a Digital Data Platform that shall provide information to non-governmental organizations within the framework of the Electronic Government system;

within two months, to submit to the Cabinet of Ministers a draft normative legal act providing for the connection of non-governmental organizations to the Digital Data Platform, as well as the provision of data available in the information systems of all state bodies and organizations to non-governmental organizations exclusively through the Digital Data Platform;

by June 1, 2022, to create the possibility of using the public services specified in Annex No. 4 to the present Decree, without confirmation through an electronic digital signature on the SPIPS;

by August 1, 2022, to implement organizational and technical measures to introduce the Mobile-ID system for the use of public services, as well as a new procedure for submitting personal data using the Electronic Government system.

8. In order to ensure confidentiality and reliable protection of personal data, from August 1, 2022, to introduce the procedure for obtaining personal data using the Electronic Government system, in accordance with which:

upon requesting personal data by state bodies through the Electronic Government system, these data shall be sent to the personal account on the SPIPS or to the subject's mobile phone number identified through the Mobile-ID system (except for cases that include state secrets and information access to which is restricted in accordance with the legislation);

upon performing work and providing services by economic associations, state organizations and institutions, non-governmental organizations that have received permission to use the Electronic Government system, personal data shall be submitted through the Electronic Government system with the consent of their subject. In this respect, personal data shall be submitted to the relevant organization through the Electronic Government system after receiving confirmation from the personal account at the SPIPS or the mobile phone number of the personal data subject identified through the Mobile-ID system.

To the State Center for Personalization, together with the Ministry of Justice, within three months, to submit proposals to the Cabinet of Ministers on establishing the framework and restrictions on the use of personal data through the Electronic Government system based on the powers, functions and activities of state bodies and other organizations.

9. To establish a procedure according to which, from June 1, 2022:

persons registered in the information system Unified Register of Social Protection, and their children, as well as young people included in the “Youth Notebook”, shall be exempt from paying fees charged for participation in admission tests conducted when enrolling to higher educational institutions;

self-service places shall be created in the centers for the use of electronic public services by the population and business entities. In this respect, at least one of the operators operating in the centers shall be involved in providing direct assistance to persons wishing to independently use public services;

upon making payments collected for the use of public services through the branches of commercial banks located in the centers, in cash or non-cash form, a separate fee for the amount of a commercial bank commission in the amount of up to two percent shall not be charged (with the exception of state duty payments). In this respect, the commissions of a commercial bank shall be transferred at the expense of the fee charged for the use of services, with a proportional decrease in the amounts sent to each of the recipients;

officials and responsible employees of organizations, regardless of their organizational and legal form, which are entrusted with the functions of providing public services or implementing other administrative procedures, shall be responsible for violation of acts of legislation in the field of public services delivery.

10. To the Ministry of Justice, by July 1, 2022:

together with the Ministry for the Development of Information Technologies and Communications, the Center for the Development of Electronic Technologies and the State Center for Personalization, to submit to the Cabinet of Ministers a draft normative legal act on the introduction of a procedure for identifying a person through the Mobile-ID system;

to hold a tender for placement in the centers for up to five years without charging rent of branches of commercial banks that accept payments for public services;

to submit proposals to the Cabinet of Ministers on amendments and additions to acts of legislation arising from the present Decree.

11. To make amendments and additions to certain acts of the President of the Republic of Uzbekistan in accordance with Annex No. 8.

12. To invalidate certain acts of the President of the Republic of Uzbekistan in accordance with Annex No. 9.

13. To the National Television and Radio Company of Uzbekistan, together with the Agency for Information and Mass Communications and the National News Agency of Uzbekistan, to ensure wide coverage in the media of the essence and content of the present Decree.

14. To assign to the Minister of Justice R.K. Davletov and the Minister for the Development of Information Technologies and Communications Sh.Kh. Shermatov personal responsibility for the effective organization of the implementation of the present Decree.

The National Strategy for the Modernization and Accelerated Development of the Public Services Delivery System for 2022 — 2026 (hereinafter referred to as the Strategy) has been developed in accordance with the Decree of the President of the Republic of Uzbekistan dated July 24, 2021 No. UP-6269 “On measures to improve the infrastructure for the public services delivery and expand population access to public services”.

The strategy shall define the goals, objectives and priority areas for the modernization and accelerated development of the public service delivery system, with account taken of the current state of the public services delivery and the best practices of foreign countries in that area based on the principle of “Citizen in the center of attention in the delivery of public services” (Citizen — centric service).

Chapter 1. General Provisions

Further improvement of the public service delivery system plays an important role in minimizing the human factor in the interaction of the population with government agencies, reducing bureaucratic processes, reducing the time and costs of service users, and ensuring transparency and openness of administrative procedures.

In the state policy pursued to expand the range of provision of electronic public services, one of the priority tasks shall be further improvement of the favorable business environment in the country, to deliver users high-quality and efficient public services.

The Ministry of Justice and the Ministry for the Development of Information Technologies and Communications of the Republic of Uzbekistan, together with other authorized bodies, shall ensure the implementation of the present Strategy.

For the implementation of the Strategy:

road maps shall be developed and the measures defined in them shall be implemented;

analysis of the activities of authorized state bodies and organizations in the field of public services delivery shall be carried out;

public services delivery processes shall be optimized through using business process reengineering (BPR) methods;

social surveys shall be conducted among the population;

the material and technical base of public services centers shall be strengthened;

information and communication technologies used in the public services delivery shall be improved.

Chapter 2. Description of Current Situation and Existing Problems

As a result of reforms carried out over recent years in the system of public services delivery, a modern infrastructure has been created to deliver convenient and responsive public services to the population and business entities.

In order to ensure the transition of the national system for the public services delivery to the population to a qualitatively new level, public service centers (hereinafter referred to as the Center) were created in each district (city) in 2017.

As a result of reforming the system for the public services delivery, 172 public services, out of more than 750 public services, have been delivered through the Centers, 308 public serviced delivered through the Single Portal of Interactive Public Services of the Republic of Uzbekistan (hereinafter referred to as SPIPS) and the information system “License” in an interactive form.

Up to date, more than 32 million services have been provided to natural persons and legal entities through 207 Centers and 141 of their branches.

The total period for the public services delivery has been reduced from almost 787 days to 471 days. In the field of entrepreneurship, 132 licensing and permit procedures have been cancelled.

In order to create convenience for the population, a procedure has been introduced for using public services on an extraterritorial basis, and the practice of demanding 73 types of documents and certificates from citizens and entrepreneurs by state bodies has also been canceled.

As a result of the introduction of new forms of rendering public services, the provision of 17 public services in a composite form has been established.

As a result of the introduction of the public services delivery through the Centers, more than 200 procedures have been revised and simplified.

At the same time, there are the following systemic problems that negatively affect the further development of the system for public services delivery:

most of the existing public services are still provided to the population in the traditional form, and not electronically;

normative legal acts regulating the public services delivery do not correspond to modern forms of the public services delivery and the principles of administrative procedures, and the practice of establishment of the procedure for the public services delivery through intradepartmental acts is still retained;

applicants still face excessive efforts in connection with the refusal of authorized bodies providing public services to apply priority rights and benefits established by other acts of legislation, motivating this only by compliance with official rules and requirements;

work on the systematization of normative legal acts that determine the grounds for the public services delivery with similar procedures has not been put into practice at the proper level, what leads to an artificial increase in the number of acts of legislation;

in the unified register of public services there are still public services duplicating each other, several services that are in fact part of one service, as well as public services that have lost their relevance;

fees for the public services delivery by the competent authorities are charged in excess of the costs incurred by them for the provision of these services;

causes of systematic violations of the procedure for the public services delivery by the competent authorities providing certain public services remain unresolved;

restoration of the violated rights of natural persons and legal entities takes a long time due to the lack of mechanisms for pre-trial appeal of illegal actions and decisions of the competent authorities when these authorities violate the procedures for the public services delivery;

insufficient provision with modern information and communication technologies or the lack of information systems in the lower organizations of the authorized bodies in the regions does not allow the full provision of interactive public services;

number of competent authorities do not identify or determine the employees who are personally responsible for the public services delivery, what negatively affects the quality of public services provided;

due to the lack of alternative ways of identifying a person, the identification process when using public services by citizens remains largely dependent on an electronic digital signature;

low Internet speed across the country and the fact that the fiber-optic network does not reach remote areas lead to low performance in the delivery of electronic public services;

lack of digitization of most of the information used in the public services delivery limits the level of access to all the capabilities of the Electronic Government system;

mobile application for public services does not fully cover the services in demand, and it is not possible to use this application until the completion of the service, and therefore the scale of independent self-use of electronic public services remains low;

authorities for the public services delivery have not created the necessary infrastructure for persons with disabilities, as a result of which the applicants face inconvenience in accessing services in the social sphere;

lack of systematic work on development of the knowledge and skills of the population to get remote electronic access to public services leads to long queues at the Centers and hinders the introduction of new types of services that are in demand;

due to the insufficient qualification of employees providing public services, or their specialization in a certain area, the quality of public services remains low;

complexity of the processes for issuing some acts of civil status registration and the fact that they still depend on the human factor and are not transparent create unnecessary difficulties for the population in this area.

Chapter 3. Goals, Objectives and Principles of Strategy

The Strategy shall pursue the goal to increase the range of public services delivery in easy-to-use, convenient and transparent forms for natural persons and legal entities, expand the possibility of independent remote use of electronic public services and create an inclusive environment by ensuring equal conditions for all in the public services delivery.

For achievement of that goal, the main objectives of the Strategy shall be:

providing convenient ways to apply for public services;

regulatory impact assessment of the Centers and SPIPS by simplifying their procedures before introducing new services, mainly through the organization of pilot services in a specific region;

determination of effective mechanisms for reliable pre-trial protection of violated rights of natural persons and legal entities;

improvement of the SPIPS mobile application and expansion of the possibilities of using popular services through this application;

improving the position of the Republic of Uzbekistan in international rankings in the field of Electronic Government, the development of public services;

increasing the efficiency of the Centers;

phased transfer of some public services to the private sector.

The Strategy shall be based on the following principles:

Citizen shall be in the center of attention in the public services delivery (Citizen — centric service). This principle implies that the organizational and legal mechanism of public services will be created with maximum convenience for the user. This, in turn, requires the active participation of users in the implementation and improvement of public services.

Creating high social value at low cost. In order to ensure a high level of user satisfaction in the public services delivery, the state must effectively use advanced management technologies, public-private partnerships and the principles of a market economy.

Innovative development of public services. It is necessary to use a mechanism for introducing innovations, monitoring, quality control and making timely operational adjustments to the system of public services.

For further increasing the responsibility of authorized bodies in the public services delivery, developing effective mechanisms for ensuring the timely provision of services to the population and social protection of workers, the following measures shall be envisaged:
