In order to further improve the system for the provision of public services for affixing an apostille on official documents in accordance with the Decree No. 1566 of the President of the Republic of Uzbekistan “On measures to implement the provisions of the Convention Abolishing the Requirement for Legalization of Foreign Public Documents” (The Hague, October 5, 1961)” dated July 5, 2011, the Cabinet of Ministers decrees

1. Establish that, from March 1, 2022, introduce the procedure for providing public services for affixing a special stamp “Apostille” (hereinafter referred to as Apostille) on official documents drawn up on the territory of the Republic of Uzbekistan by authorized state issued bodies to individuals and legal entities through Public Service Centers and (or) Unified Portal of Interactive Public Services (hereinafter referred to as UPIPS).

At the same time, it should be determined that the procedure for providing public services according to official documents drawn up on the territory of the Republic of Uzbekistan by the competent state bodies, individuals and legal entities in the traditional manner will be preserved.

2. Approve the administrative regulations for the provision of public services for the apostille of official documents, providing for the following, in accordance with Appendix 1, and to enter into force on March 1, 2022:

the procedure for providing public services to individuals and legal entities for affixing an electronic apostille on official documents drawn up by authorized state bodies on the territory of the Republic of Uzbekistan through Public Service Centers or UPIPS;

the procedure for providing public services to individuals and legal entities for affixing an apostille to official documents drawn up on the territory of the Republic of Uzbekistan by authorized state bodies using the traditional method;

at the request of the applicants, the procedure for providing them with consultations (certificates) on apostille issues by an employee authorized to consider apostille issues and an employee of the Public services center;

Implementation of constant control and monitoring of the activities of state bodies and other organizations to implement the requirements of this Regulation by the Public Services Agency under the Ministry of Justice, its territorial departments and Public Service Centers.

3. The Public Services Agency under the Ministry of Justice shall ensure the development and launch of the “E-App” (Electronic Apostille Program) and “E-register” programs that provide technical support for the provision of public services for the electronic apostille on official documents until January 1, 2022.

The Ministry for Information Technologies and Communications Development of shall ensure the examination of the design and technical documentation of these programs in the prescribed manner.

4. Ministries, departments and local government authorities should regularly send samples of signatures of persons authorized to sign official documents and seals and stamps to:

to the Ministry of Justice of the Republic of Karakalpakstan, regional and Tashkent Board of justice – on official documents issued by the judicial authorities and institutions of the relevant territory and civil registration authorities;

to the Supreme Court – on official documents from the courts;
Suggestion to the documentListen to audioGet a link from a document element
the Prosecutor Generalʼs Office of the Republic of Uzbekistan – on official documents emanating from the prosecutorʼs office, investigation, inquiry and carrying out pre-investigation checks;

To the State Inspectorate for Quality Control of Education under the Cabinet of Ministers – on official documents emanating from organizations in the field of education and science;

Ministry of Foreign Affairs of the Republic of Uzbekistan – on other official documents.

5. Ministry of Justice, the Ministry of Foreign Affairs, the State Inspectorate for Quality Control of Education under the Cabinet of Ministers, together with the Supreme Court and the Prosecutor Generalʼs Office should ensure following:

by March 1, 2022, include in the “E-App” program signatures and samples of seals and stamps of officials authorized to sign valid official documents;

in the event of a change of officials authorized to sign official documents, regularly update their signatures and samples of seals and stamps to sign official documents in the “E-App” program;

Together with the Ministry of Development of Information Technologies and Communications and the Public Services Agency under the Ministry of Justice, ensure the connection of all departments involved in the provision of public services to the UPIPS.

6. The Ministry of Justice, the Ministry of Foreign Affairs, the Supreme Court, the General Prosecutorʼs Office, together with the State Inspectorate for Quality Control of Education under the Cabinet of Ministers, will organize and conduct training and practical seminars aimed at improving the efficiency and effectiveness of the implementation of the administrative regulation approved by this resolution, within a month, with the participation of employees of Public Service Centers.

7. The Ministry of Information Technologies and Communications, together with the Public Services Agency under the Ministry of Justice, shall introduce a procedure for monitoring the consideration of applications at each stage of the provision of public services in the UPIPS system.

8. Public Services Agency under the Ministry of Justice shall:

establish permanent control over their activities, including through the UPIPS, in connection with the implementation of the established procedure for the provision of public services by state bodies and other organizations;

apply administrative penalties in the prescribed manner to officials of state bodies and other organizations for violation of the requirements of the administrative regulations approved by this Resolution.

9. Some decisions of the Government of the Republic of Uzbekistan shall be considered invalid in accordance with Appendix 2 from March 1, 2022.

10. The Ministry of Justice, the Ministry of Foreign Affairs, together with other interested ministries and departments, within a month, shall bring the legal documents adopted by them into line with this Resolution.

Chapter 1 General Provisions

1. This Regulation determines the procedure for the provision of a public service (hereinafter referred to as the public service) to individuals and legal entities (hereinafter referred to as applicants) by affixing a special stamp “Apostille” (hereinafter referred to as an apostille) on official documents drawn up by authorized state bodies on the territory of the Republic of Uzbekistan.

In accordance with Article 5 of the Convention Abolishing the Requirement of Legalization for Foreign Public Documents (The Hague, October 5, 1961) (hereinafter referred to as the Convention), an Apostille certifies the authenticity of the signature, the quality in which the person who signed the document spoke, and the authenticity of the seal or stamp that binds the document.

2. The following basic concepts are used in this Regulation:

apostille – a special stamp affixed for use abroad on an official document in accordance with the Convention, certifying the authenticity of the signature, the quality in which the person who signed the document acted, the presence of his / her authority to sign, and the authenticity of the impression of the seal or stamp that is affixed document;

affixing an apostille – a formal procedure necessary to certify the authenticity of a signature, the quality in which the person who signed the document acted, the presence of his / her authority to sign, and the authenticity of the seal or stamp that affixed the document;

authorized state body - a state body authorized to affix an apostille in accordance with the Resolution No. 1566 of the President of the Republic of Uzbekistan “On measures to implement the provisions of the Convention Abolishing the Requirement of Legalization of Foreign Public Documents (The Hague, October 5, 1961)” dated July 5, 2011;

“star-bug” – thick paper, which is sealed at the place where the sheets of the document are fastened and on which the official seal of the authorized state body that affixed the apostille is affixed.

“E-App” program – a program that generates a special stamp affixed for use abroad on an official document in accordance with the Convention, certifying the authenticity of the signature, the quality in which the person who signed the document acted, the presence of his / her authority to sign, and the authenticity of the impression of the seal or stamp that is affixed document;

“E-register” program – an electronic registry program that includes actions related to the generation of a special stamp on an official document that is applied by an authorized state body in accordance with the procedure established by law for use abroad through the “E-App” program and making changes to this stamp.

3. An apostille is affixed to official documents to certify the authenticity of the signature, the quality in which the person who signed the document acted, the presence of his/her authority to sign, and the authenticity of the seal or stamp that affixes the document.

The signature, seal or stamp affixed to the Apostille does not require additional certification.

4. Public service, in accordance with the Resolution No. 1566 of the President of the Republic of Uzbekistan “On measures to implement the provisions of the Convention Abolishing the Requirement of Legalization of Foreign Public Documents (The Hague, October 5, 1961)” dated July 5, 2011, will be provided by the following bodies:

5. Apostille is not affixed to:

documents made by diplomatic missions or consular offices of the Republic of Uzbekistan abroad;
Suggestion to the documentListen to audioGet a link from a document element
documents directly related to commercial or customs operations;
Suggestion to the documentListen to audioGet a link from a document element
passport of a citizen of the Republic of Uzbekistan, ID-card, military ID.

6. At the request of the applicant, an apostille on an official document is traditionally affixed in accordance with Appendix 1 to this Regulation or in electronic form in accordance with Appendix 1а .

related to affixing an apostille to an official document are carried out using the “E-App” and “E-register”

7. In the process of electronic apostille of an official document, the exchange of information between Public Service Centers and authorized state bodies is carried out only through interdepartmental electronic interaction using an electronic digital signature (hereinafter – EDS) without fail.

8. An apostille may not be required on a public document if the laws, regulations or customs of the country in which the document is presented, or an agreement between two or more contracting states, makes it easier or exempt from legalization of the public document.

9. Competent state bodies and Public Service Centers consult individuals and legal entities on the apostille procedure free of charge.

Chapter 2 The procedure for the provision of public services

1-§. Traditional apostille procedure

10. The applicant applies personally to the authorized body to receive public services. Instead of the applicant, third parties acting on the basis of a power of attorney may apply.

11. An employee of the authorized body fills out the questionnaire in electronic form in accordance with Appendix 2 to this Regulation on behalf of the applicant.

A notarized copy of an official document or unofficial documents used on the territory of a foreign state party to the Convention is attached to the application form. After filling in and entering the necessary information into the application form, the applicant confirms it with his signature.

12. The following fee is charged for consideration of an application for apostille affixing:

For official documents emanating from organizations in the field of education and science – in the amount of 20 percent of the base calculated value;

For official documents issued by the judicial authorities and institutions of the relevant territory and civil registration authorities – in the amount of 20 percent of the base calculated value;

For other documents – in the amount of 10 percent of the base calculated value;

If the applicant refuses the submitted application, the amount of the fee paid is non-refundable.

The amount of the fee will be distributed in the manner prescribed in subparagraph “c” of paragraph 30 of this Regulation.

13. The application will be considered by the competent authority within two working days from the date of submission of official documents.

14. If it is necessary to request a sample signature and confirm the authority to sign a specific official who signed the official document submitted for apostille, and (or) request a sample of the seal of the organization from which the official document originates, the term for consideration of an application for apostille affixing on an official document is not must exceed ten business days.

In this case, the applicant must be notified by the authorized body of the extension of the period for consideration of the questionnaire.

15. In official documents submitted for apostille, the relevant details (number, date, signature, seal) and signatures of officials, the authenticity of seals and stamps are checked, including using the “E-App” and “E-register” programs.

16. Signatures of officials and seals contained on official documents submitted for apostille must be legible.

If the official document has amendments and (or) additions, they must be specified by the person who signed the document. The specified additions and (or) amendments must be made so that everything erroneously written, and then corrected and crossed out, can be read in its original form.

17. Apostille is refused in the following cases:

in the absence of at least one of the necessary details in an official document in accordance with paragraph 15 paragraph 15 of this Regulation, or if the signatures of officials and seals and stamps are found to be invalid;

if the official who signed the official document does not have the authority to sign it.

18. If the competent state body refuses to affix an apostille on the grounds provided for by this Regulation, a notice of refusal is sent (delivered) to the applicant in writing, indicating the reasons for the refusal and the period (30 calendar days) during which the applicant, having eliminated these reasons, can submit official documents for reconsideration.

An employee of the authorized body on the same day notifies the applicant of the refusal by phone or “SMS message”.

19. There is no fee for re-examination of the application.

An application submitted after the expiration of the period specified in the notice of refusal is considered to be re-submitted.

20. Apostille is done by pressing the Apostille imprint on an official document after the stamp is generated by the “E-App” program and filled in with the information contained in the generated stamp.

It should be possible to check this stamp in the “E-register” program through a special number provided by the “E-App” program

21. In accordance with Appendix 3 to this Regulation, the apostille must be made in the form of a square block measuring 10 x 10 cm. The heading of the Apostille must contain text in French.

Apostille affixing by photocopying or any other method different from affixing an apostille imprint is not allowed.

22. The apostille imprint is affixed to a place free from the text of an official document, either on its reverse side or on a separate sheet of paper.

In the case of affixing an apostille imprint on a separate sheet, the document sheets and the sheet with the apostille imprint are numbered and stitched with a thread of any color or a special thin cord, ribbon. The last sheet of the document in the place where it is stitched is sealed with a thick paper “star-bug”, on which a seal is affixed with the image of the State Emblem of the Republic of Uzbekistan (hereinafter referred to as the official seal). The imprint of the official seal is located evenly on the "asterisk" and on the sheet. The number of stitched sheets is certified by a stamp containing information about the number of stitched and numbered sheets.

23. The employee fills in the apostille stamp he/she has affixed.

Line 2 of the Apostille imprint indicates the name of the official who signed the official document submitted for Apostille affixing.

If the official document does not provide for the signature of a specific official and his surname, and the document comes from the name of the organization, line 2 of the apostille imprint indicates: “signature is not provided” (in the language of filling in the apostille imprint), and line 4 - the official name of the organization, from which the document originates.

When affixing an apostille to a copy of an official document certified by a notary public, in line 1 of the apostille imprint, after the words “Ushbu rasmiy hujjat/this public document”, the words “notarized copy” (in the language of filling the apostille imprint) are indicated, and in lines 2, 3, 4 - surname of the notary, position and name of the state notaryʼs office, respectively.

Line 3 of the Apostille print indicates the position of the person who signed the public document. If an official document is signed by several persons, the official position of the chief of them by position (for example, the presiding judge in the composition of the court) is indicated.

Line 4 of the Apostille print indicates the official name of the organization that issued the official document.

Line 5 of the apostille print indicates the city in which the apostille is affixed.

In line 6 of the apostille imprint, the date of the apostille is indicated in numbers.

Line 7 of the apostille print indicates the surname, position of the person who certified the official document.

Line 8 of the Apostille imprint indicates the number corresponding to the serial number in the Apostille Registration Book.

In line 9 of the apostille print, the official seal of the authorized state body is affixed.

In line 10 of the apostille imprint, the signature of the person who affixed the apostille is put.

Changes (corrections, erasures) in the text of the Apostille imprint are not allowed.

If it is necessary to submit a translation of an official document in the state of presentation of the apostille, these documents, after affixing the apostille, are translated into the language of the country of presentation of the apostille (or into English) by the translator, including the apostille, after which the translatorʼs signature is certified by a notary, and at the end, an apostille is affixed to the certified translation .

24. An employee of the authorized body on the same day presents the applicant (his representative) with an apostilled official document and makes an appropriate entry in the “E-register” program and attaches a scanned PDF copy of the apostilled official document.

At the same time, the applicant, having presented a document confirming his identity, confirms the receipt of official documents with an apostille with his signature or other means of identification (dactyloscopy, electronic signature, etc.)

2-§. Electronic apostille procedure

25. The applicant applies for a public service to the Public Service Center in person or electronically after registering with the UPIPS.

26. An employee of the Public Services Center, on behalf of the applicant, fills out a questionnaire in electronic form in accordance with Appendix 2 of this Regulation to official documents issued by the competent state authorities, through a personal account when contacting through the Public services center..

27. A notarized copy of an official document or unofficial documents used on the territory of a foreign state party to the Convention is attached to the application form.

28. The applicant is not required to confirm the questionnaire in the EDS. The fact that he successfully passed authorization from the UPIPS means that he personally submitted the application.

In the case of a personal appeal, the questionnaire can be confirmed by other means of identification (dactyloscopy, etc.).

29. All official documents are scanned by an employee of the Public Services Center and sent to the authorized state body within 10 minutes in PDF format using the system of interdepartmental electronic interaction.

30. The applicant is charged a fee of 20 percent of the base calculation value for consideration of the aplication.

90% of the amount of the fee specified in the first paragraph of this clause is charged when applying for the provision of public services through the UPIPS.

The amount of fee is distributed as follows:

a) when applying in person to Public Service Centers:

60 percent – to the State budget of the Republic of Uzbekistan;

0.5 percent – to a special account of the Information and Communication Technologies Development Fund to finance interagency e-government and digital economy projects;

The fee for official documents issued by organizations in the field of education and science is credited to a special account of the State Inspectorate for Quality Control of Education under the Cabinet of Ministers of the Republic of Uzbekistan and is distributed in the following order:

31. The application will be considered by the competent authority within two working days from the date of submission of official documents.

32. If it is necessary to request a sample signature and confirm the authority to sign a specific official who signed the official document submitted for apostille, and (or) request a sample of the seal of the organization from which the official document originates, the term for consideration of an application for apostille affixing on an official document is not must exceed ten business days.

33. In official documents submitted for apostille, the relevant details (number, date, signature, seal) and signatures of officials, the authenticity of seals and stamps are checked, including using the “E-App” and “E-register” programs.

34. Signatures of officials and seals contained on official documents submitted for apostille must be legible.

If the official document has amendments and (or) additions, they must be specified by the person who signed the document. The specified additions and (or) amendments must be made so that everything erroneously written, and then corrected and crossed out, can be read in its original form.

35. Apostille is refused in the following cases:

in the absence of at least one of the necessary details in an official document in accordance with paragraph 33 paragraph 15 of this Regulation, or if the signatures of officials and seals and stamps are found to be invalid;

36. If the competent state body refuses to affix an apostille on the grounds provided for by this Regulation, a notice of refusal is sent (delivered) to the applicant through Public Service Center or UPIPS in electronic form to the personal e-cabinet, indicating the reasons for the refusal and the period (30 calendar days) during which the applicant, having eliminated these reasons, can submit official documents for reconsideration.

37. In the case of affixing an apostille, the authorized state body sends the apostilled official document in electronic form to the Public Services Center (in the case of a personal application) or to the applicant (in the case of an electronic application) through the UPIPS.

38. The Public Services Center sends it to the applicantʼs e-mail address within 10 minutes after receiving the apostilled official document in electronic form and informs the applicant about this through the information and communication system.
