                                                            <p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">2022-yil 28-oktyabr sanasida O‘zbekiston Respublikasining Yangi Mehnat kodeksi qabul qilindi. Mazkur kodeks bilan oldingi tahrirdagi Mehnat kodeksida keltirilmagan ko‘plab masalalar huquqiy jihatdan tartibga solindi. Xususan, ish xususiyatining o‘ziga xosliklaridan kelib chiqqan holda ayrim kasb egalarining mehnati bilan bog‘liq huquqiy masalalar alohida belgilab o‘tildi. Sportchilar ham shular jumlasidandir. Sportchilar deganda mehnat vazifasi sport musobaqalariga tayyorgarlik ko‘rishdan va muayyan turdagi yoki sport turlari bo‘yicha sport musobaqalarida ishtirok etishdan iborat bo‘lgan xodimlar tushuniladi. Quyida sportchilar mehnati bilan bog‘liq qonunchilikda belgilangan muhim qoidalar keltirib o‘tiladi:</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Sportchilar bilan tuziladigan mehnat shartnomasida ularga xos bo‘lgan bir nechta muhim shartlar ko‘rsatilishi lozim.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Mehnat qonunchiligiga asosan, xodim bilan tuziladigan mehnat shartnomasida ish joyi, mehnat vazifasi, mehnatga haq to‘lash shartlari, ish vaqti va dam olish vaqti rejimi hamda shu kabi shartlar ko‘rsatib o‘tilishi lozim. Biroq, ish beruvchilar spotchilar bilan mehnat shartnomalari tuzayotganda, unda quyidagi muhim shartlarni ham kiritishlari lozim:</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">ish beruvchining mashq tadbirlari o‘tkazilishini va sportchining sport musobaqalarida ishtirok etishini ta’minlash majburiyati to‘g‘risida;</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">sportchining ish beruvchi tomonidan belgilangan sport rejimiga rioya etish va sport musobaqalariga tayyorgarlik ko‘rish rejalarini bajarish majburiyati to‘g‘risida;</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">sportchining sport musobaqalarida faqat ish beruvchining ko‘rsatmasi bo‘yicha ishtirok etish majburiyati to‘g‘risida;</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">sportchining xalqaro dopingga qarshi tashkilotlar tomonidan tasdiqlangan dopingga qarshi qoidalarga rioya etish, doping nazoratidan o‘tish majburiyati to‘g‘risida;</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">ish beruvchining sportchining hayoti va sog‘lig‘i sug‘urta qilinishini, shuningdek sportchining qo‘shimcha tibbiy va boshqa xizmatlarni olish maqsadida tibbiy sug‘urta qilinishini ta’minlashga doir majburiyati to‘g‘risida.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Ish beruvchi sportchilarni tibbiy ko‘rikdan o‘tkazishni tashkil etishi hamda moddiy-texnik vositalar bilan ta’minlashi &nbsp;shart.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Sportchilar mehnat shartnomasini tuzish chog‘ida dastlabki majburiy tibbiy ko‘rikdan o‘tishi shart. Shuningdek, mehnat shartnomasining amal qilishi davrida sportchilar topshirilgan ishni bajarish uchun yaroqliligini aniqlash hamda kasb kasalliklarining va sport jarohatlanishlarining oldini olish maqsadida davriy majburiy tibbiy ko‘riklardan o‘tadi. Majburiy tibbiy ko‘riklarning o‘tkazilishi ish beruvchi hisobidan amalga oshirilishi shart.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Bundan tashqari, ish beruvchi o‘z mablag‘lari hisobidan sportchilarni sport kiyim-boshlari, sport anjomlari va ashyolari, ular mehnat faoliyatini amalga oshirishi uchun zarur bo‘lgan boshqa moddiy-texnika vositalari bilan ta’minlashi, shuningdek mazkur kiyim-boshlar, asbob-uskunalar, anjomlar, ashyolar va vositalarni foydalanishga yaroqli holatda saqlashi lozim.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Sportchilarga kamida 4 kalendar kun qo‘shimcha ta’til berilishi lozim.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Mehnat qonunchiligiga asosan, yillik asosiy eng kam mehnat ta’tilining muddati 21 kalendar kunni tashkil etadi. Biroq, qonunchilikda ayrim toifadagi xodimlar uchun yana qo‘shimcha ta’tillar berish nazarda tutilgan. Xususan, sportchilarga 4 kalendar kundan kam bo‘lmagan yillik qo‘shimcha mehnat ta’tili berilishi lozim, tashkilotning ichki lokal hujjatlarida yoki mehnat shartnomasida mazkur ta’tilning uzoqroq muddati ham nazarda tutilishi mumkin.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Sportchi ma’lum muddatga boshqa ish beruvchiga o‘tkazilishi mumkin. &nbsp;</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Ish beruvchi sportchining sport musobaqalarida ishtirok etishini ta’minlash imkoniyatiga ega bo‘lmagan hollarda, ish beruvchilar o‘rtasidagi kelishuvga, sportchining o‘z yozma roziligi bilan, bir yildan oshmaydigan muddatga vaqtincha boshqa ish beruvchiga o‘tishiga yo‘l qo‘yiladi. Vaqtinchalik ish joyidagi ish beruvchi u bilan muddatli mehnat shartnomasi tuziladi hamda dastlab tuzilgan mehnat shartnomasining amal qilishi to‘xtatib turiladi. Sportchining boshqa ish beruvchiga vaqtincha o‘tish muddati tugaganidan keyin dastlab tuzilgan mehnat shartnomasi to‘liq hajmda qayta tiklanadi.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Biroq, agar boshqa ish beruvchiga vaqtincha o‘tish muddati tugaganidan keyin sportchi vaqtinchalik ish joyidagi ish beruvchida ishlashni davom ettirsa va taraflar muddatli shartnomani bekor qilib, dastlabki shartnomani tiklashni talab qilmasa, dastlab tuzilgan mehnat shartnomasi bekor qilinadi va vaqtinchalik o‘tish davri uchun tuzilgan mehnat shartnomasi taraflar kelishuvi bilan belgilanadigan muddatga, bunday kelishuv mavjud bo‘lmagan taqdirda esa nomuayyan muddatga uzaytiriladi.</span></span></p>

<p style="text-align:justify; margin-bottom:11px"><span style="font-size:14pt"><span style="font-family:&quot;Times New Roman&quot;,serif">Sportchi o‘z tashabbusiga ko‘ra mehnat shartnomasini bekor qilish to‘g‘risidagi ogohlantirish muddatining davomiyligi mehnat shartnomasi taraflari tomonidan tegishli sport turi yoki turlari bo‘yicha O‘zbekiston Respublikasi sport federatsiyalarining (assotsiatsiyalarining) tavsiyalariga ko‘ra O‘zbekiston Respublikasi Sportni rivojlantirish vazirligi belgilaydigan muddatlar inobatga olingan holda aniqlanadi.</span></span></p>
